Mediator & Arbitrator

Mr. Eagle serves as a mediator and arbitrator, helping parties in dispute resolve their conflict in an out-of-court setting. As a mediator, drawing on his experience as a litigator and business attorney, as well as his extensive training in mediation and experience as a mediator, he helps parties identify their interests and needs and the strengths and weaknesses of their and their adversary’s positions so that they can engage in a constructive effort to resolve their dispute. As an arbitrator, Mr. Eagle relies on his experience as a commercial litigator and in arbitration proceedings when adjudicating disputes.

Mr. Eagle has served as a mediator since 2009 in commercial matters including disputes between partners, shareholders and members of companies; disputes involving claims of conversion, fraud, malfeasance and breach of fiduciary duty. His cases have included claims of mismanagement and malfeasance by and between shareholders in a closely held corporation and the demand for the appointment of a receiver; derivative claims brought by a member of a limited liability company against the managing member for breach of the operating agreement and fraud; a dispute over an investment banking company’s entitlement to a fee following a completed transaction based on its contract with another investment banking; claims by a company that a long-term employee had resigned and diverted business; claims resulting from a sale of a business; disputes over amounts claimed due on loans; a dispute over the entitlement of a seller to payment of the balance of the purchase price and related claims arising from the sale of a business; claims over amounts claimed due on commercial and residential leases; disputes between a company and former employee; a dispute over a “paymaster’s” liability for a payment received by him and then remitted to a third party without the payor’s consent; FLSA and other employment claims; ADA claims; disputes between homeowners and insurance companies resulting from Super Storm Sandy; and disputes amongst and between condominium owners, neighbors, and between a condominium owner and the board of managers.

As an arbitrator, Mr. Eagle’s cases have included disputes involving claims under the Electronic Funds Transfer Act; disputes resulting from commercial lending arrangements; disputes concerning consumer debt; claims under the Fair Credit Reporting Act and Fair Debt Collection Practices Act; and claims of breach of contract, unjust enrichment, tortious interference with contract, breach of the duty of good faith and fair dealing, and fraud.

Mr. Eagle is on the panel of mediators of the United States District Court, Southern District of New York, and is a member of the Southern District’s Mediation Advisory Committee. Mr. Eagle serves on the rosters of mediators and arbitrators of the American Arbitration Association, the roster of mediators of the Commercial Division of the Supreme Court of the State of New York, County of New York, and the roster of mediators for the NYCBA Co-op and Condo Mediation Project

Appointments

NYSBA Committee MemberBart Eagle was appointed as a member of the New York City Bar Association delegation to the New York State Bar Association House of Delegates in April 2024. Bart Eagle is a member of the New York State Bar Association (NYSBA) Dispute Resolution Section (DRS) and Commercial and Federal Litigation Section, is a former co-chair of the DRS Mediation Committee and a former member of the DRS Executive Committee, a member of the DRS Arbitration Mediation, Dispute, Prevention and ADR in the Courts Committees, and a member of the DRS Chair Advisory Council. Mr. Eagle is also a member of the New York City Bar Association (NYCBA) Alternative Dispute Resolution Committee, the Council on Judicial Administration (CJA), which coordinates the activities of the City Bar’s state court committees and addresses broad-based issues affecting the New York court system, including judicial selection, court restructuring, and court operations and finances, the CJA’s Efficiency Working Group, and the Legal History Committee. Mr. Eagle is the former Chair of the NYCBA State Courts of Superior Jurisdiction Committee.

Mr. Eagle serves on the Mediation Advisory Committee of the United States District Court, Southern District of New York.

Mr. Eagle is a member of the International Institute for Conflict Prevention & Resolution (CPR) and CPR’s Arbitration, Mediation and Dispute Prevention Committees.

Prior Experience, Bar Admissions & Other Associations

Before entering private practice in 1988, Mr. Eagle was an Assistant District Attorney in Queens County, New York, for six and one-half years. As a member of the Homicide Trial Bureau, the Major Offense Prosecution Program, and a Supreme Court Trial Bureau. Mr. Eagle investigated, tried, and obtained convictions for murder, other armed and violent felonies, and economic crimes.

Mr. Eagle is admitted to practice law in the United States Court of Appeals for the Second Circuit, the United States District Courts for the Southern and Eastern Districts of New York, before the Supreme Court of the United States and in the State of New York.

Mr. Eagle has taught seminars and workshops in trial advocacy to junior attorneys and judged the moot court and mock trial competitions at St. John’s University School of Law. He is a graduate of the University of Miami School of Law, where he was a member of the Moot Court Board and served as an instructor Advanced Moot Court Workshop.

In addition to practicing law, Mr. Eagle was a Trustee and Vice Chair of Children’s Aid and currently serves as Trustee Emeritus.
